Student Discipline - Right to Appeal (AVN)

Purpose

This policy outlines the procedures for appealing disciplinary decisions made by Avondale School, ensuring transparency, fairness, and adherence to principles of natural justice. The school is committed to a restorative and respectful approach to student discipline that aligns with our Christian values.

Scope

This policy applies to all students and parents/guardians seeking to appeal disciplinary actions taken by the school, including suspensions, exclusions, or other significant disciplinary measures.

Principles

  • Every student and family has the right to appeal significant disciplinary decisions.
  • Appeals are handled in a fair, impartial, and timely manner.
  • The appeal process prioritises restorative practices and reconciliation.
  • All matters are handled with confidentiality and respect for all parties involved.
  • Outcomes are based on accurate, complete information and sound judgement.

Grounds for Appeal

Appeals may be submitted on one or more of the following grounds:

  • New evidence has emerged that may affect the outcome.
  • Procedural fairness was not observed.
  • The severity of the decision is disproportionate to the behaviour.
  • The facts or context were not fully or correctly considered.

Appeals Process

Step 1: Initial Communication

Within five (5) school days of being informed of a disciplinary decision, the student or parent/guardian should first discuss the matter with the staff member or leader involved to seek clarification or informal resolution.

Step 2: Formal Appeal Submission

If the matter remains unresolved, a formal written appeal must be submitted to the Head of School. 

The appeal must:

  • Be submitted within ten (7) school days of the original decision.
  • Clearly state the reason(s) for the appeal.
  • Include any supporting documentation or evidence.

Step 3: Review by Head of School

The Head of School will acknowledge the appeal, conduct a review of the decision, and consult with the School Executive. A decision will typically be provided within ten (10) working days of receiving the appeal. The decision of the School Executive is final and no further appeals will be heard by the school. 

Step 4: Complaint to NNSW SDA Schools

If the matter remains unresolved, a formal written appeal must be submitted to the NNSW SDA Schools. A complaint should only be made if the parents/guardian can show that the school acted outside of its policy, and procedural fairness was not observed or extenuating circumstances were not given consideration.

Outcome Notification

All outcomes of appeals will be communicated in writing, outlining:

  • The review process
  • The rationale for the decision
  • Any changes or actions to be taken

Record Keeping

All appeals and outcomes are documented and stored confidentially in the student’s record. Access to these records is limited to relevant personnel.

EVALUATION: This policy was last updated in April 2025 and will be reviewed as part of a three-year school policy review cycle in 2027.
